DEPUTY PATROLLING HOLTS SUMMIT OBSERVES MOTORIST DISCHARGE SHOTS ALONG US HIGHWAY 54

Earnest Nichols, 34, of Holts Summit
Narrative:
On January 1, 2018 at approximately 12:10 a.m., a Callaway County Sheriff’s Office deputy was parked on South Summit Drive adjacent to US Highway 54 near Holts Summit. The deputy observed a vehicle travel from US Highway 54 onto the overpass and then park approximately 100 feet from the deputy’s vehicle. The deputy watched as the driver and sole occupant exited the vehicle and discharge a pistol five times into the air.
The deputy immediately approached the driver, identified as 34 year old Earnest Nichols, and placed him into custody and secured the pistol. During an investigation it was determined the pistol, a Hi-Point 9mm, malfunctioned and jammed as the shots were being fired. A computer check of the serial number showed the pistol was reported stolen to the Cole County Sheriff’s Office in 2011.
Nichols was transported to the Callaway County Jail where he was posted a $5,000.00 court set bond for the offenses of Unlawful Use of a Weapon and FELONY stealing.
The investigation is ongoing and further charges could be forthcoming. NO FURTHER INFORMATION WILL BE RELEASED AT THIS TIME.
